I being a settler cum Trustee of a public charitable trust registered at State of west Bengal (India).
The trust got registered on 28th November 2008, having one settler & Three trustees. While the setler himself is one of the trustee.
Even after getting registered the trust is unable to proceed its scheduled work in accordance to its registered objectives.
The problem is that out of 3 trustees one the the trustee has rebelled which is quite detrimental to the interest of the trust.
We the mejority among trustees has following alligations against him :
1. He does not not responded to any of our correspondence since beginning of this organisation.
2. He is not attending any board meetings due to which the organisation has got stagnated.
3. Despite Several request from board of trustees and the Settler himself he shows no concern to the pending liabilities and necessities of the organisation.
4. He do not sign the documents of further priorities such as PAN card application, 80G registration, and opening of bank account e.t.c. which are basic need for any non-profit organisation.
5. The worst part is that you gave illegitimate offers to one of our trustees detrimental to the interest, objectives and laws of the Trust, Not only this but you have justified your views by filthy allegations to a respectable section of society.
6. He intend to utilize the organisation as profit making body, though he knows that we are a nonprofit organisation.
7. He is found making negative propaganda against the organisation, which is absolutely detrimental for the organisation.
We therefore want him to resign, But he even refuse to resign please tell us what should we do ?
Please reply us as early as possible.
