We moved into our rental house on Saturday, 2-28-09. In just days we found out that the foreclosure paperwork was filed with the courthouse on Monday, 3-2-09, and that the house will be foreclosed upon 4-7-09. It is infuriating to us to know that we moved into a house whose owner most certainly knew was going into foreclosure. We have been told this is called "skimming". What are our rights as far as living in the house until and/or after the foreclosure on 4-7-09? Will we receive a notice from the bank about moving out? If so, how much time will we have? Our lease was for a year, which was fraudulent, since the owner knew he would not own it for a year. What is the law in this situation? We live in Texas.

You need to google your state and foreclosures and renters. Every state is having this problem with unscrupulous landlords. AZ is trying to pass a law to make it a misdemenor for a landlord to do this and not give 30 days notice.

Did you put down a deposit? I would pay your next months rent with this. Also just because the house is foreclosed on does not mean you will get evicted immed. You can call the mortage company to see if they will even talk to you but it is doubtful. It could take months to formally evict you. Have you approached the LL about this? There are so many houses where I live in foreclosure that it is taking at least 6-9 months from the date of foreclosure to actually get an eviction. You can also go to your county assesors website and find out whose name the house is in. once the bank takes ownership of the house you can perhaps call them and see about making rental payments to them.
