Request father to give up rights

My daughter's biological father & I broke up since I was pregnant with her. He is now in jail and I'd like for him to give up his parental rights. I am now living with the father of my second child and are planning to get married. How do I go about him giving up his rights and my fiance adopting her? Would it be two separate legal actions or can they be done at the same time?

Is the bio Father listed on the birth certificate? The bio Father has rights even if he is in jail. You can't just go & remove his rights to child & have your fiance adopt child after you are married.

There is no law that prohibits you from asking him to give up his rights; there is no law you can invoke that will force him to do so if he refuses.

It's way too soon to be taking about a step-parent adoption (which would be a separate action)
