requirements for asking boarder to leave

My Mother & my stepfather have had a boarder for the past few months (a friend of my stepfather's)- with no written agreement. My Mom is getting a divorce (stepfather has moved) and she wants the boarder to leave. The boarder has not really done anything wrong (except for running up the electric bill and not cleaning up after herself very well) (Currently she is also late with the rent, although- as I said- there is no written agreement) What are the requirements/remedies for asking her to leave? Thank you - We are in Texas.
 
How does tenant pay rent? Weekly monthly? There are two options

1. Give notice to vacate time frame depend son how tenant pays rent and your states laws

2. Give notice to pay or quit since rent is late.
 
She pays monthly....I don't know where to look to find the laws regarding this issue.
Does it make a difference when there is no written agreement?
Does it make a difference that she is just renting a room?

Shes renting that is what matters. Now you need to google your states laws to find out if you giv e a 30 day or 60 day notice to vacate. You can also contact an Attorney who works on Tenant/Landlord disputes for info as well. You need this info to protect yourself. The pay rent or quit notice also has a time period likely three days before you can begin eviction process. Not having paperwork means she is on month to month lease thats all and actually easier to get her out.
