My question involves a child custody case from the State of:

My girlfriend is about to continue her education by going back to college and would like for our daughter to stay with me which I will have residential custody. What she doesnt want is to go through the hassle in court for this. Is there a form for New York State that can be filled and notarized for the proceeding of this? Its not for legal purposes though. Its just for my housing office to have proof of authorization from her so I can add my daughter as a tenant on my lease. Is there no specific form they have for this? Someone told me a temporary guardianship form would do it im not quite sure

I presume you're the bio-dad. If you are, is your name on the birth certificate? Have you established paternity? Are you paying court ordered child support?

I suggest you both discuss your options with an attorney. The initial consultation is free. That's when you can ask questions, learn your options.

There's no form that would prove the child is your daughter. There are other ways to prove that. But, a consultation with an attorney is where you should start.

Mom should also think long and hard about this. Seeking an education doesn't mean you have to give up being a mom. She can pursue her education and still care for the child. People do that everyday, men and women single parent, and do it well.

Most universities have child care options for students. Most universities have family housing available to single parent and two parent families, too.
