While we were married, my wife and I purchased a car for her in both our names. My former wife and I were issued a divorce decree Jan 2008. Part of the settlement was that "the wife shall be awarded as her sole and exclusive property a certain...automobile that she has in her current possession and that she shall pay and forever hold the husband harmless from making any payments related to said vehicle".

The car has now been repossed and the finance company is coming after me, threatening to garnish my wages. My former wife has purchased a new car and refuses to take any action citing lack of funds.

Am I liable? If so, what is my recourse?

Once you do the formalities, the bank will release the title to you and whoever buy the car want the title. so make sure that when you receive funds from seller, you pay the bank.

Yuo are still liable and the bank does not care about what your divorce says. Personally if she was not making payments, I would have gone and picked up the car from her. You could have also asked in the divorce that she refi the car in her name only.
