Responsibility of Debt

To what extent is a spouse responsible for the debt of a deceased spouse? Are you responsible for debts that are in the deceased spouse's name only? What type of actions can be taken if one refuses to pay the debt of a deceased spouse if there is not estate filed.

Normally a spouse is only responsible for necessities furnished to the deceased. This usually includes medical bills, nursing home fees, etc. This is specific depending on state law.

If there are assets, a creditor can open probate and have someone named as the PR.
