I have an old landlord that is saying we owe 120.00 in late fee's from last sept and oct. We moved out in oct and we got our deposit back in full in December. shortly after we got a "bill" from him for late fee's. Since he did not take these out of our deposit are we legally responsible?

The purpose of security deposits is to assure that a tenant pays rent on time and keeps the property in good condition. In addition, there are usually limitations on how a security deposit can be used by a landlord. If your landlord didn't deduct the fees was probably due to those limitations. Now, if you know that you owe the late fees and chose not to pay them, your former landlord can take you to small claims court to recover them. Good luck to you!
