Retail accident

Last year I was in a Walmart store with my daughter of 4. We were at a register checking out. When the cashier bagged our items, she spun the little triangular bagging station and one of the metal arms on the bagging station hit my daughter in the face cutting her cheek slightly. They asked me if I wanted to file an accident report and I said no. I figured it was just a small thing and would heal fine. Well it's over a year later and there is still a nice visible scar on her face. Is there anything I can do at this point since I did not fill out an accident report at the time of the incident?
 
I know that the cashier should be paying attention, but I think this is also one of those times I'm going to have to just be blunt.

You as that parent needed to also keep a better eye on your child. You know the thing spins, were you watching your daughter? Did you see her next to it? And before you ask, yes I have kids - ages 7 and 4.

It reminds me of one time not too long ago in Wal-Mart. We were in the outdoor section (that's actually still indoors) and this kid, maybe 10, was playing around with the automatic door to the outside garden area. Well, it slid open, and over his arm. Dad came over and started freaking out, demanding an ambulance, and saying his kid needed his arm x-rayed. It was obvious from how the kid was moving his arm that there was nothing really wrong with it. But this is very much the same kind of thing. Yes, the door could have hurt the kid, but at the same time dad should have been keeping a better eye on his kid.
