Illinois--- So the other day i was about to exit the store with a shopping cart of around $110 of merchandise i didnt pay for. a plain-clothed security guard stopped me at the door and i tried to run. (so i never actually left the store with the items.) she was a very big woman and wrestled me against the wall when i tried to run. i was brought into their office and the police came and arrested me. i was brought to the police station for booking and fingerprints then let free. im charged with retail theft and recieved a court date.

im 20 and this is technically my first offense beacuse i had a misdemenor in the past that was expunged. some of the merchandise was alcohol and i'm of course underage. is this somthing i need a lawyer for?
what type of punishment would i get if showed up for court without a lawyer?
can you expunge offenses multiple times?

some answers would be very much appreciated, thanks

YES! you need a lawyer your facign two possible charges "minor in possesion" and retail theft. Because you had an earlier criminal case that was expunged Diversion may not be an option

You passed points of sale. You don't actually have to physically leave the store with the items to mkae it theft.

on the court notice paper they gave me at the police station, it just said the offense was retail theft, didnt say anything about possesion. so can i still be charged with minor in possesion?

wow we are in basically the same situation: http://www.thelaw.com/forums/showthread.php?t=48161

i have court on the 27th so ill tell you if they charge me with the alcohol or not

You tried to run and got caught. This kids is a lesson in why you do not steal. Also, you most likely would not have gone to jail had you cooperated. Now you are in a heap of trouble.

Get a lawyer. You need one.

The DA has you at their mercy.

In some states resisting/fighting with security can get you extra charges too.
