retail theft

I was charged with retail theft for 44 dollars and the officer was very nice and said he would only charge me with a first time summary offense and not a misdemeanor or felony. He fingerprinted me at the station. When I asked him if it would show up on my FBI record or criminal record he said probably not because the background checks are only looking for misdemeanors and felonies which he did not charge me for. when I submitted my criminal background check the status said Request under review. he told me to call Algerstate which is counseling service and take 4 sessions and he also said that he feels that me taking 44 dollars was not deceptive on my part which is what he felt since I was on antipsychotic medication which made me confused. he said plead not guilty and by taking Algerstade and ARD program it will become NO Record. is this true and why would it come up Request under review for status.
 
I suggest you plead not guilty, hire a lawyer, or request a public defender.

Then meet and talk ONLY with your lawyer, shut up, stay out of trouble, and wait.

If you're printed and a mug shot is sent to the FBI, the cat is outta the bag, the bell has been rung.

It's always possible when you are arrested, charged & fingerprinted that it might show up on a background check by some agencies, employers etc. You haven't been to court yet so it is going to show under review. You need a lawyer to talk to - talk only to the lawyer.

Also, the retail store could have reported you to a theft retail data base where it could show up for member retail stores unless possibly you are a minor.
 
These programs you mention vary by county so you need to talk to a Lawyer to ensure your record remains unblemished once you successfully complete the program. In addition as mentioned above your name could be placed into a Retail theft database if the store subscribes to one. Even if a CRB does not pick up the theft the database will show you were stopped for shoplifting. this can impact you if you seek workin retail or with any company that subscribes to said database.
 
Not all background checks are created equal. What shows up on any given background check is going to depend on what questions are asked by the pending employer. There is no way anyone can guarantee what will and will not show up on a background check.
