We ordered baby furniture at a national chain in June 2007. Gave credit card for deposit that was charged while we were in the store. Were told store's policy was to charge remaining balance to same credit card prior to delivery. Delivery made in late July 2007.
In August 2008, we were contacted by retailer's store manager and told they never charged our credit card for the balance due. Card now expired. In letter from manager he referred to this as "an oversight on our part," not the store's error.
Admittedly, we made many purchases before the birth of our daughter in August 2007 and did not pay attention that this was not charged.
Are we responsible for this balance due? Is there any statue of limitations to this type of billing? What should we be expected to pay, if anything? How should we proceed?
