Employee lets ceo know about racial harassment and that a co-worker had hit him. Employee tells room fill of supervisors and no corrective action was taken. Ceo told the employee that he was going to do an investigation. During the investigation ceo found out that these things did indeed take place. Ceo was afraid that the employee was going to sue, so he was told to get some type of incentive, to go after the employee. The employee has never had a write up nor has he had a evaluation down, since he had been in the company for nine months. Ceo finds out that the employee has lied on his resume. He calls hr and the employee for a meeting. The employee told the truth about the resume. Ceo decides to suspend the employee for two weeks without pay. Told him to clean his desk and give company keys back. Ceo also tells the employee that he has two weeks to gather up his 10 year work history and report it back to HR. Is this retaliation?

Q: Is this retaliation?

A: Maybe. But we would have to hear the other side.

It could be a maybe. Here is the thing the employee knew nothing on how the investigation was going. Did this company do an investigation and found out that these allegations were indeed true? So they were afraid that the employee was going to sue? Therefore they needed to get some type of incentive to cover there mess?

Besides it is only human nature. You hit me, I hit you.
