retirement inheritance

My father died in early 2003. My mom died 9 months later, before receiving his retirement benefits. His retirement was in stocks and she decided to let them build a little more before receiving them. I was sole beneficiary. My dad's company refused to give me the retirement because my mom never requested it. Would I stand a chance at getting this? The estate has been closed since mid-2004.

Sorry to hear about the passing of your parents so quickly. From what I know about estate law, you should be able to get them because you are the sole heir to your parents' estate. What you are telling me the company said sounds ridiculous but I wouldn't doubt it could be true. Be assertive. Get the agreement if you can and, if you don't, call up whomever is in charge at the company and tell them they can deal with prosecution or do it the easy way unless they can point to exactly why retirement benefits that are obviously owed to your fathers estate should somehow be property of the company.
