I used to work for a private child development center in washington, dc. I recently resigned from that job in August 2008. Prior to resigning i worked for the company for 5 years. I recently was made aware of a check that the employees received on september 16, 2008, pertaining to retro pay of 5% on the hourly rate which was $12.00 beginning from january 2008. I would like to know am i entitled by law to receive any of the retro pay even though i do not work for the company .

If I am not mistaken, since you don't work for them anymore, you are not entitled to anything. However, there is a possibility that they may issue something between your last paycheck and the day the retropay was issued. Stand by for other responses...

Retro increases are not required by law in any circumstances barring a bona fide contract or CBA that specifically says otherwise. So even if you WERE a current employee retro pay would be a gift of the employer, not a right.
