I work retail, cashier. Another cashier comes through my register, she is derogatory towards me, yelling. I handled the situation wrong, lowered myself to her level. I seen her at the time clock. I approached her and told her in a quiet self-controlled voice- Don't you ever ****** talk to me in front of customers like that again, and I walked away from her. Immediately knew I was fired, the manger was standing right there. He started yelling at me in front of the other employees, he wouldn't take both me and the other girl together to talk the situation over. He pushed, yelled and pressured me for 20 minutes, already knowing I was terminated.
When I got let go the next day, they had on me discrimination, threat, and inappropriate language. They wrapped that up nice and pretty didn't they. I want to reverse the discrimination, I feel I was discriminated against and I want my personal work record cleaned up. The only thing I did was use an inappropriate word. Take heed people, this is a non-union place and they are big time in the retail industry.

What is your legal question?

Can anyone get a lawyer, in a situation like this, and have their personal work record cleaned up? Or... file a discrimination suit against them, for them discriminating against me in a situation like the one above? There was no threat to anyone and I don't know where the discrimination even comes into it. It never happened. Her report about the situation was never revealed to me, one of the reasons I wanted both of us in the room at the same time. She was derogatory to me but I got slapped with discrimination against her when it was all done and over with.
