Revocation of suspension of sentence and probation

The basis of the story... last year I was put on probation for speeding (reckless driving). I was fined $500 with a 60 day license suspension. Another $500 and a 10 day jail sentence was suspended on good behavior. Well, I got two more speeding tickets after this. My last ticket was on March 23rd of LAST year. I just got served (at my parent's house, which I no longer live there) to go to court on the 24th of February because I broke probation. Apparently, I'm looking at jail time. I guess it would be considered general district court. My problem is.... this was over 7 months ago, I've since had a baby (he's still a newborn) and I'm breast-feeding him. I cannot be away from him. Should I find a lawyer? Or what should I do? And, is there any way to avoid jail time? Is there something saying medically my son cannot be away from me or what? He also has severe reflux and we have no one to watch him if I go to jail (I'm a stay-at-home-mom) and we cannot afford daycare.

Yes, by all means hire a lawyer or ask the court to appoint one to represent you (assuming you can't afford your own).

Whatever you do, do not fail to go to the February court date.

If you appear, you'll probably be allowed to return home on your own recognizance.

But, just in case, set aside some bail money.

You might be required to post a bond.

I would guess it would be no more than $10,000, for which a bondsman will secure your release for around $1,000 paid to him or her.

It may be less, or you may be allowed to be released on your signature.

Ask a respected person to accompany you to court.

If you have to post bond, someone will be required to stand behind your signature as a surety guarantor.

Remember, do not miss court.

If you can hire a lawyer, now would be the time to do so.

And about your baby, don't even try using the baby as an excuse NOT to go to jail or prison.

The court has heard that before, and it won't make a difference.

Using a lawyer will be better tactic!



 
Thanks. So, the date in February... is that just a "preliminary hearing" so-to-speak as I have no idea how to obtain a court appointed lawyer other than when they ask you in court. Who would be considered a respectable person? Would my husband suffice? I don't plan to use my son as an excuse but rather he's the motivation behind wanting to get this taken care of and to avoid jail time. I don't plan to go into a "sob story" about my son when facing the judge. I've heard those before and they're nothing shy of corny.
