I am a renter of a privately owned condo. Most of the other near-by people own the condos. There is a disabled man who owns his condo next door. He is bipolar and lives with a younger man who is not a licensed caregiver nor does he work for any agency. They constantly fight, scream, yell, threaten, and slam doors at all hours, almost daily, at all hours of the day and night.
The police are here constantly, sometimes 2-3 times a day. Last Friday afternoon I cam home to 3 cop cars parked outside the units, and they were both taken away in hand cuffs, each has a $50,000 bail.
One woman who's a owner requested that I help her with a petition she is trying to put together. I gave her the address of my landlord and told her to mail the letter she wrote to the HOA on site managers, to him. I also emailed the HOA President who replied "just keep calling the police." The HOA President and complex manager is a joke. She likes them and says they are just gay boys who "have their fights."
I have intermittent high blood pressure and have had to watch the older man run around in his underwear chasing the younger man with his cane, smashing in his car windows and banging on the other mans car to the point it was no longer able to be driven, not to mention being awakened at 3:00 am by screams for help, just to get one of the neighbors to call the police since he calls them so many times they don't even believe him. My heart was pounding so hard and fast that I thought I was on the verge of a real heart attack!
I cannot sit on my deck outside on a sunny day since it's across from their unit. Their dog is either barking or they are yelling, or the older one is locking the younger man out and he's running around the unit trying to get in etc. The police say the older man calls them sometimes 50 times a day! They are fed up but are limited in their scope and can only do so much.
They have left their little dog alone in the house for days at a time (currently it's been 3 going on 4 days in a row), it constantly barks, and no one knows if theres any food or water inside, the poor dog has no where to poop or pee! Today the Animal Control put a notice on their door, but that's it. I thought they may have come to take the dog but no luck.
What recourse do we all have? As I mentioned, I am a renter but get along with my landlord and can't afford to move as rents have risen and I have a good deal here and a job nearby. Can we have a class action lawsuit against the HOA because they won't do anything about this? or something else? Is "right to quiet enjoyment" only for tenants or does it also apply to owners?
