My boyfriend and I bought a home together 6 years ago. We broke up and he was going to buy me out. I moved out Sept. 13th and he still has not acquired a mortgage. What are my rights to file to have the house listed for sale on the market? Also we had a verbal agreement that he would do repair work on my car (he manages his father's automotive shop) in exchange for furniture I purchased long before I met him. He still has not done the repair work and will not let me come into the house to get my furniture. When I tried to get it he called the police and they said I have to file a civil suit and not to return to the home or I could lose my case in court. What are my rights as half owner?
 
If it is your furniture and you have a receipt where you bought it, you need to go talk to the magistrate. "File a civil suit" means the police don't want to get involved so you have to go over their head. Since you are an owner he cannot prevent you from entry and from getting your personal items and the police are required to assist you.

However, this could esclate the situation and you are in a bad position, especially since you are also on the mortgage I would assume. That means filing suit and $$$ and probably two years before you can even put it on the market. I doubt you can even sell it right now anyway.

Your best option is to have an attorney contact him and get him to sign a real estate contract. I would not contact him yourself. The attorney can probably also arrange for you to get your personal items.
