Good Morning, I own a home single family residence in Oklahoma that is under a lease agreement until August of this year. The tenants have caused considerable damage to the property, I have a question about a specific occurrence. The lease agreement states that the tenants are responsible for any repairs needed to the pool or spa while they are occupying the property. The pool (in ground with a vinyl liner, 40,000 gal) worked fine and had no issues when we leased the property to them but now when they decided to finally de-winterize the pool it has 2 "tears" in the liner, according to the pool repair man these 2 spots are as large as 2 bowling balls and cannot be patched, which I was willing to do. To replace the liner it will cost 3500 dollars. The tenants say they did not do anything, that the pool was fine when they covered it before winter, the pool repairman says by looking at the holes there is no way that the pool liner ripped like that on it's own. We do not live in Oklahoma we moved with our jobs, so we are going on the tenants/pool repairman's word. We are trying to get photo's but the tenants are being really nasty about it.
The house just went on the market to be sold and as a result of not having a functioning pool we will have to drop the price of the home; can I make them pay to replace the pool liner?

One more question, do they still have to give 30 days notice even if the lease states a specific date for the lease to terminate. If there is a termination date on the lease, are the tenants responsible for putting in a 30 day notice to move? IE....30 Days prior to the termination date.

Answer: If that is what they signed for then it is there responsibility.

Answer: If you have an agreed time limit for them to leave then no they can live there to the said date then just leave or give you due notice that they would like to stay on. It is down to you the landlord to ask them if they are staying or leaving because there contract would be due to end. The only time they have to give you 30 days notice is if you state you require you want thirty days notice prior to leving the said poperty.
