Robbed by Ex-Roommate

From July 08 until December 08, I was living with at my friend, Sam's place and paying him rent. At the end of December I was incarcerated for back pay on child support and all my money went to paying that to get out. I finally got out on Jan 10th 2009 and my friend, Sam, had changed the locks of the Condo, because I had not paid him rent for January. When I asked him if I could get my things he said no, and not until I paid the rent for Jan. I did not stay there in Jan, and I didn't have the money to give him. I called the police and they escorted me to the Condo to get my things. When we arrived there they allowed me to enter my old room and get my belongings that were in there and only the things that my ex-roommate said were mine.

However, a lot of my stuff was missing, such as my PC, family photos, clothes, my organizer (which contained social security card, credit card info etc), and much more. When I told the police that this stuff was gone and they asked Sam about them, he denied that he had taken it. Therefore the police said that it was my word against his, and I had to leave with just the stuff that he said was mine.

Since then I have been trying to contact Sam to come to some short of arrangement. I am willing to pay the rent for Jan. if that means I can get my stuff back, but he is refusing to answer emails or phone. I just do not know what to do at this stage. I tried to do the right thing by asking the Police to assist me.... but it has got me nowhere. Please help.... I am so frustrated and upset. He even took my son's first baby shoe... and the only photos I have of my real Dad. These are items that cannot be replaced. :nuts:blush
 
Did Sam, your landlord, provide you the legally required eviction notice? If not, he is in serious violation of tenant/landlord relationship. He cannot lock you out. Send him a demand letter asking for what you believe he still has that is rightfully yours. In this letter explain to him the legal fault he made. (research this on the internet). In the last paragraph of this letter indicate a time by which he must comply or you will take legal steps in small claims court. Good Luck

I want to thank you for taking the time to reply to my question. I am going to work on a letter today. Also, I am planning on going to the Court House today and filing a claim.

Last night Sam actually replied to a text. He said to stop trying to contact him, or he would file a harassment report with the police.... what an Ass****
