Room mate moves into Home Rental, Moves out second day.

I went into an agreement to rent a home with a good friend. We went on a Saturday scrambling to beat the deadline of his apartment's last day the next day. He arranged for a cashier's check of 1345 rent plus +1000 deposit.. le 1345+1345 cashiers check .

Both of us scramble to get into the lease meeting and both get fair share of lease. We start moving Saturday, the next day Sunday I have feeling something is wrong, the new roommate won't tell, I call the landlord and find out: He tells me that my roomie says I have issues with the house and wants to terminate the lease after one day, so he is leaving. My roomie moves out after one day, with telling me a thing, The landlord ask me to leave also, and I plead with him to let me stay and keep the rent going. He asks me to leave by 5PM, two hours notice to pack up and leave. So I abide by his wishes, barely making the deadline.

Now I get a request from the roomie to fax a signature sheet that I also wanted to terminate the lease along with him, because it's the only way the landlord will give back the deposit and I get my 800 dollars back. I argue I didn't want to terminate the lease and I want my $800 now since 24 hours after I gave it to my roomie, I was kicked out.

So, now I need to know, do I have to fax that sheet saying I wanted to terminate to be able to get my $800 back in thirty days, that my roomie will control. Do I have to trust him to give it to me.

What happens if I don't agree and ask the landlord to give me my portion. And isn't this an illegal termination if I don't agree with termination. My roomie also has control of two expense checks from work in his mailbox and won't let me come over anymore for some reason, I was living there for a month, paying half rent waiting for this home, when I was kicked out, he left me cold and no where to live, I slept in the car until my mother could bail me out with money because the 800 was my last money and he has 250 of checks he is holding until I sign and fax this paper. Any one help me????????

Should I sign and wait, or deadline and sue?

What does the lease say regarding paying back deposits? Lot of strange stuff going on. If you want your check back from the landlord, contact him. Regarding your friend, you may have to sue him and pick better friends next time. Sorry to hear about your troubles...
