What is the name of your state? Georgia

In July 2005, my current roommate and I rented an apartment together. Because I had no credit history only her name was listed on the lease and I was listed, I believe, as another person occupying the appartment (kind of as a dependent). But the lease is on her name. The utilities are also on her name. I pay her every month half the rent. She pays the office directly. I also payed half the deposit, but to my roommate. We have had problems and arguments (disagreements over space, cleaning) and furthermore she brought in her brother to stay with us. She is now saying I have 2 weeks (15 days) to leave and she will change the locks. Can she kick me out? If so, can she only give me 15 days notice? Am I a tenant or a subleasee? Do I have the right to claim my part of the deposit back from her? Your help is most appreciated.

At the very minimum she has to give you 30 days. even though you are not on the written lease, there is a verbal contract in place.

If she changes the locks though since you are not on the lease you are probably out of luck. Your best bet is to look for another place and let her know you expect your part of the deposit back (providing you are paid up on rent) or you can sue her in small claims.
