My jurisdiction is: Nevada

My son, who was working as a cashier for Albertson's in Florida sold alcohol to a minor and was given a summons to appear in court. I believe this is a class 2 misdemeanor but I was wondering what to expect with the outcome. He is 31 years old and has a "clean" adult record and had one incident of B&E as a minor when he was 16.

He is devestated by this as he recently got "temporary" custody of his 2 kids as the mother was sent to drug rehab for abuse of prescription drugs. With this incident he's scared the county will take away his kids and now doesn't have a job to even support them. As parents, my wife and I agreed to take them in with us here in Nevada and provide their support providing Florida does not send him to jail and/or prevent him from leaving the state with probation, etc.

I will be at his hearing on May 4th and have contacted an attorney there (haven't gotten back to me yet) so I just need some info as to what to expect.

I'm thinking he'll get a fine $500 or so, community service and maybe probation. The probation is what is scaring him. Is this realistic for a first-offender of any sort?

Appreciate any information.

This is not an offense that should affect the custody of this kids, I don't think anyways. Dad though sending the kids to NV to live with you without permission of the courts or mom might be troublesome. If mom has any visitation with the kids Dad is in interference of it. So don't assume you can keep the kids there. Plan on sending them back when Dad finds a job.
 
Thanks, yes we know he can't just take the kids without court's permission. We was just hoping that he won't be looking at probation that WOULD keep him from any possibility of that happening. We would get the blessing of the mother, as well, before we petitioned the court to allow such a move.

Do you think he can avoid probation since this is his first offense?
