I just started a new job in Md. I was currently and went on the interview. The position I applied to to was explained and so was compensation. I told them I had to think about it and would call him (the owner)he said ok but wanted me to start right away. Told him I would call him in the morning the next day. When I called I asked for more compensation and 2-weeks vacation, he agreed To 1100.00 salary and 2-weeks vacation. I quit my current job and told him I would start on Monday. I did and everything seemed ok till I started hearing him go off and cuss and verbally abuse other people. Also heard him discuss barely making payroll and being way behind on bills of all sorts...This company is incorporated and has over 50 employees. Their revenue is 1-2 million per year. Anyway I received no training on the computer system my first week and things seemed amiss but ok. On my sixth day(mon.) I was about to leave for lunch and he went off cussing threatening to fire me. He wanted to know what I was doing that morning so I showed him all that I had done and he told me if I didn't sell something that day not to come back the next...He used vulgar language in a threatening tone. I didn't sell any thing and ask my manager if I should return and he said yes you are doing just fine That's just him he said. I sold 8,000 in my 1st week without training. Returned the next day and the verbal abuse and threatening continued but not at me. It was directed at lots of different people and he made several of the girls in the office cry. The rest of the week I didn't take lunch or a break because that is what seemed to set him off. I witnessed more of the same all week and more of the companies problems(financial) all week long. On Friday I was to get my 1st check for 11,00 at 4:30, had to wait till 6pm which was fine that's when I finish. When I got my check it was much less then agreed upon so I told him this is not what we agreed on(verbally) and he went nuts... Jumping up from behind his desk and snatching check out of my hand and ripped it to shreds and told me to get the F out of here and not come the F back and to get the F out of his face.(he is mentally unstable). He then proceeded to stomp around and huff and puff like some kind of madman. I was afraid but I wanted my check so I said I'm not leaving without a check so he said he would make me another one, I waited 30-mins. for this and he finally gave it to me. Since I was told not to come back I asked for my second weeks check also, and was told I could pick that up on Fri. like everyone else. Today is Sat. and went to bank to cash check they would not cash said to speak with employer. Called the manager and he said go to Wal-mart and cash...They would not. Now he won't return my calls. Oh I forgot, I hadn't even got home when the manager called and said I should come in on Monday if I wanted it was up to me. He also said that, that's just the way he is not to worry about it, it is what it is he said. So what am I to do? I still haven't been paid and I don't see how I can go back. By the way he also refers to the one African American as the" N" word when he is not around. This man is mentally unstable so I don't know what to do. Should I contact the US Dept. of labor or the attorney generals office or what. I have to have a job I have a family and home and cars and bills. Unemployment is nowhere near enough to survive and I will lose my home. PLEASE PLEASE HELP ME DISTRAUGHT,MORDIFIED, Thank you.

I believe 99% of what you said.
That is one sad story.
Try to write everything down in chronological order, make sure you record who was present and record as much as you can remember of what BIG BAD BOSSMAN said to whom, when he said it, and who was present.
Be very discrete with that journal, and keep it always on your person.
Each day make copies of it, and keep the original safely at your home.
Use a cheap, plain little pocket notebook to capture each rant, diatribe, abuse fest he unleashes.
Don't let anyone but your wife and your lawyer see those reports.


You might want to discuss this with a labor lawyer on Monday, or as soon as you can.
This is far too complex for us to address fully here.
That said, if what you say is even 50% correct, you just might have hit a rather nice little jackpot.
There are some things you could do to help support your case, but you need an in person consultation with a local labor relations or employment attorney FAST & FIRST.
Good luck, keep your cool, show up on Monday, ask for a couple hours off to see your DOCTOR (that lawyer you need to see).
 
Thank you for your time, I'm not looking for a jack pot, just want what's owed to me and a job that pays the same without having to go on unemployment. Can't survive on unemployment, will lose everything fast. I will contact a lawyer first thing Monday, and I have a journal that I started when he went off on me the first time. Thank you again!!!!
 
I see several problems here.

The first and most obvious is that the employer hasn't actually done anything wrong so far. Unethical, perhaps. But not illegal.

Being a rude, insensitive bigot is sadly not illegal. The only thing I can see that would be vaguely questionable legally speaking, is the check issue.

I'm curious though - it is not common practice to tell a customer "speak to your employer" when you present a check.

The other problem is, you cannot force them to hire you nor can you force them to pay you X amount unless you have a specific contract (as long as they're paying minimum wage). You can just about guarantee that if they're forced into a corner, they'll find a legal way of making your life hell.

Ultimately I'm not convinced you actually have a case for anything other than the check issue.
