I am 56 y/o and trying to support my family and have put an offer down on a janitorial service business which was pre qualified for an SBA guarnateed loan . Now I am looking over the application and it is asking me if I have EVER been arrested for anything other than a minor traffic violation. Well , yes I have been arrested ,, 19 years ago I was pulled over and arressted for DUI . upon reviewing the facts , my video tape and a few other things like my breathalizer reading was under the legal limit for being DUI , the case was reduced to a reckless driving ticket ,, and according to my lawyer was expunged too. Still must I still disclose this information on my application ,. likme it says I MUST do . I am trying to earn an honest living here ,, and I do not want anything to interferr with it .. I just do not want to have this incident of 19 years ago come back to haunt me . If I just do not list it ,, will the SBA's routine background investigation unearth this mess somehow and ruin me ? I know the State of Florida has no record of it after 11 years ,, but does the FBI hang onto this stuff forever ? Please advise . I do not want to disclose this matter under these circumstances because I cannot see how it can possibly help my case . Does stuff like this even get sent to the FBI ? Will the SBA contact the FBI on an SBA loan appication ? Aside from this ,, I have a clean record and perfect credit Thank you .
