scooter damages

my husband and friend stopped at motor cycle store. while in the sales area a shop employee came out and asked my husband and his friend would it be alright for HIM to move their scooter because they where blocking him. they sure go right ahead. about 30mins latee after they left they stopped at gas station, at that time my husband buddy notice that there where scratches on the scooter. as they where discussing the damage our 6yr son (who was with them) said daddy the guy dropped your scooter a cycle store. they returned back to cycle store to speak with manager (the employee had already left). other empolyee told him the manager had left for today and call tomorrow. today my husband called the manager to resolove the issue. the manager asked his employee did he dropped the their scooter (of couse he said no )he said that he didn't touch their scooters at all. who would be responsible for damages the owner or the employee?

A: Probably both. However, how do you plan on proving who did anything?
 
can our son be a witness? and another customer stated (according to the manager) that he seen the employee move a scooter but he wasn't sure which one.
 
Take the bad people to small claims court; the judge will answer all your questions.
 
That would be the point of our civil courts. If you (or anyone other than a judge) were able to determine who was at fault in a contested matter, what would be the point of our judicial system?
