Seat Belt and Airbag not working

I was in a car accident Sunday 11/30/2008 and it was my fault. I
hit someone from the rear. My seat belt did not lock and my air bag did not
deploy, causing me to come up off my seat and my head
hitting the windshield. I went to the ER, luckly nothing major, just bad
whiplash. I was wondering if it is worth taking leagal action against the
car company about my seat belt not locking and airbag not delpoying? I made a complaint with Chevy, but have not heard back from them.

That all depends on the angle and area of your vehicle that actually impacted the other vehicle, as well as speed. Some airbags do not deploy under certain circumstances. Did you have your seatbelt on correctly?
