Security Deposit lawsuit

My wife and I moved out of a townhome that was managed by JDR Realty, owned by Vestcor Properties. We received a notice by USPS that we have a certified letter waiting for us at the general mail facility here in Jacksonville, FL. Well they can't find the letter to deliver to us. So we contacted JDR Realty to find out if it was our security deposit.

My wife found out over the phone they are imposing a claim for the full security deposit ($900). They said there were stains on the carpet, had to repaint the house, and charged for cleaning. It was in our lease that we had to pay for a carpet cleaning service to steam clean the carpets. We have a receipt as proof of this. The house was left in very good condition with no stains on the carpets and it was very clean. There was some normal wear and tear on the walls (minor dents from moving) and a small section might've needed to be repainted due to a black chair that rubbed against it.

According to FL statutes we have 15 days to advise we are objecting to their claim on our security deposit. I am wondering if I take this to court will I have a good case. Do they have to show proof of the damages (pictures)? We had no pets so I don't know what stains they could be talking about.

One thing I question is we had contacted JDR Realty several times to setup a final walk-through of the property. We were given the runaround on that issue so it never happend. What should we do? Is it worth spending the money to file in small claims court?

They would have to show proof of these damages. You would have to show proof of the opposite. Hopefully you took pictures at the moveout so you can show that you left the unit in good condition.
