My old landlord is now trying to take money from my security deposit for a broken window I did not break. My final walkthrough papers make no mention of a broken window because there wasn't one. We are in th 47th day after I moved out and she is just finally about to return my money with only the window broken fee deducted. I have read Colorado State law and it states that there are only 30 days to respond with this claim and therefore she must give me the full amount back. I don't know what to do now and if my claim is valid. I have complied three points against her arguement and I need to know if I could possibly win a civil action to receive my deposit back in full.
1. Security Deposit was not returned within 30 day (which was specified by Colorado State Law)
2. She never provided an itemized deduction list until the 42nd day (I had to contact her for the deposit to be returned).
3. My walkthrough papers make no mention of a broken window caused by me.
Any guidance in this matter would help immensly. Thanks.
