I have a tenant-couple and one daughter lived in my rental home in Georgia. The lease agreement was signed by the husband (wife name is not on the lease but wife and daughter have been living there since). They have been paying the rent. They are in the process of divorce and the husband moved out a month ago. He wants the S/D back. The wife cannot put up the S/D but has no problem to pay the rent. Can I deny his request because his wife and daughter are still living there? They may seek out who take custody of the S/D in their divorce settlement? I want to keep the S/D until the wife and daughter move out in the future.

Yes, you can keep the deposit until the residence is vacated. That is the agreement in the lease, is it not?
