SEEKING A LAWYER AND ADVICE!

I am being charged with a crime I did not commit. I was shopping in a supermarket grocery store and a distant relative was with me at the time. I went there to purchase some boxes of bulk pizza and some bulk pretzels, he put them in the cart for me and then I proceeded to go to the bread and pastry section of the store. He was pushing the shopping cart down the aisle with my groceries and he stopped and started looking at some razors which were hanging on a rack with a knob that said turn to open. He asked me "how does this work?" I walked up to where he was standing, I looked closer at the knob because I was not wearing my glasses to see what it read. Then I turned the knob like the instructions stated and then I walked away and started looking at other merchandise down the aisle. Then he asked me again "how does this work?" I walked over and showed him how to turn the knob again like the sign said, to just turn it, and I walked away again. I started looking at a display of coffee mugs and pots and pans about 20-25 feet away from him on the opposite side of the aisle. At no time was I paying attention to what he was doing. Then, he came down the aisle towards me with my cart and I proceeded to go to the bread section. They didn't have the pita bread I wanted to purchase so I went straight down the aisle to the check out line to pay for my items. While putting my items on the belt, this distant relative walked around the opposite aisle of the cash register. After I paid for my items he pushed my cart out the store for me. As we exited the store and went into the parking lot area, next thing I know a lady and gentleman from inside the store came behind him and shouted out saying to him "excuse me sir, you want to talk about the razors you took?" He turned to her and said "what are you talking about?" She said "the razors, it will only take a few minutes, if you would only come back in the store with me." He replied back "what razors, I don't know what you are talking about and turned and ran through the parking lot." She shouted out as he was running "if you don't have anything, why are you running?" That's when she shouted out to him "that's okay we have your picture on camera so you'll be seeing your face on crime stoppers tonight." He didn't say anything, he just kept running through the parking lot and away from the store.

In the mean time I had no idea what was going on or what she was talking about, I didn't see any razors or see him with any razors so I started walking over to my car. Then the unidentified female followed behind me and shouting out at me "I need you to call him on his phone and tell him to come back." I said "first of all I don't have a number for him, and secondly I have no idea what you are talking about." "I came to the store to purchase my groceries, here is my receipt for my groceries," I opened my bags, so she could see inside of them and then I said to her "this is what I came to the store for and I have no idea of what you are talking about." Then she started shouting at me "that's okay, that's okay I have your license plate." I asked her again "what are you talking about?" I put my groceries in the trunk, opened my car door and got in, and started my car. She then walked around to the front of the car continuously shouting "that's okay, I have your license plate number." When I went to pull off she stood directly in front of my vehicle blocking my exit so I backed up some more to give me more room to pull off and then I left, after being harassed by her. Not once did she nor the unknown gentleman identify themselves or their positions. Neither one of them told me to come back in the store and did not tell me I had to stay until the police came or I would have. All she kept shouting was "that's okay I have your license plate number. This happened Dec. 29, 2014 at approximately 8:45pm.

Then on January 6, 2015 a detective from the police station called my home stating that my license plate was given to them in a possible petty larceny complaint pertaining to some razors being taken. He asked me "can you tell me something about it?" I told him "I didn't see my distant relative take any razors." Then the detective stated "that's not what the tape shows." He said "the tape shows you were working in conjunction with him, it shows you turned the knob on the razors." That's when I told the detective "yes because he had asked me how do you work this." Then I asked the detective "I'm in trouble because I turned some knobs?" The detective said "yes." He then said "I'm going to mail a summons out to you the charge will be accessory to petty larceny and you will have a court date, it's just an arraignment you're not being arrested, booked or fingerprinted, this is just for you to appear in court. On that day you will speak to the DA and at that time if you can't afford an attorney one will be appointed to you." The the detective said "now is there any information you can give me on the person you were with and we'll serve him a warrant for his arrest. That's when I told him "he was a distant relative all I know he was staying in another state, NJ and was here for the Christmas holidays." That's when the detective said "you need to give me more than that. A date of birth or some way of finding him because the way it is looking right now, if we can't find him we'll settle for you." I said just for turning a knob?" He didn't respond to my question. Then I heard him say "unless you can give more information, the DA will be unwilling to offer or accept a plea deal." Then he went on to say that "a summons would be sent to you in the mail, make sure you make the court appearance or I'll have to make a warrant out for your arrest." I said "okay" and we hung up.

I received a summons in the mail January 15, 2015 and it said I am being charged with not accessory to petty larceny but petty larceny PL 155.25. Please if someone can help I would appreciate some advice before I obtain an attorney. I am a Registered Nurse, going to school for my Bachelors Degree in Nursing and I don't have a criminal record at all. And I can't afford this to hurt my nursing license, please help someone. This happened in the state of NY but not NYC. My summons to appear in court is January 28, 2015 at 9:00 am. If there is video footage can I also ask my attorney to acquire the full video to prove my innocence, from inside the store and outside in the parking lot?

Please respond,
Concerned citizen

Don't talk to police anymore. Either go hire an attorney or if you can't afford one wait until the arraignment and ask for one to be appointed. Talk only to your attorney, nobody else.
I'm not sure anyone will believe that you can't identify the relative, but you have no obligation to do so.
If all is as you say I would expect that with legal representation you could avoid any significant trouble from this. All evidence will be made available to you prior to any trial (not prior to arraignment).
You are not responsible for your relative's actions, and they will have to prove that you were working together. It takes more than simply being together to prove that.
They will try to scare you with various consequences to get you to accept a lesser plea offer (so they don't have to prove anything in court).
When the time comes, discuss these options with your attorney. You do not have to accept their offer if you don't want to.
Good luck .

If the woman that came out to the parking lot was merely a sales girl and not a licensed security agent for the store, did she have a right to harass me in the parking lot like she did after I showed her my purchases and receipt? Thank you for the advice.

You weren't arrested, because you didn't do anything that could be proven.
Mr. UNKNOWN is the one they want.
As Moose said, it's not your job to rat him out.
It's their job to find him.
They had him, didn't chase him because they weren't allowed, probably by store policy to pursue him.
You're innocent until the state proves your guilt.
If they had anything on you, you'd have been arrested.
They weren't cops, and even if they were, you're not required to say hello.
You're not required to explain what they saw, either, on video.
That video, with the help of your lawyer, won't explain it, nor will the video alone explain it.

Your biggest problem is you.
Never comment, never explain, it never helps.
You tried to explain. Nothing you say will ever help you. Running your big mouth, or me running my big mouth will only be used to convict me, you too!

So, stop blabbing. Wait patiently, appear in court, plead not guilty, ask for a public defender, wait some more but now you simply shut your piehole.
