Dear members of thelaw forum
Please tell me if i have a case.
I am the son of the deceased.
Here are the facts:
My father passed away a year ago.
He resided in Malaysia, but was a Singapore citizen
My family and i are Singaporeans and live in Singapore.
His death was unexpected and he did not leave a recent will.
He was muslim.
His children are not.
MUIS under muslim law is now going to sieze his unwilled assets (200K) + the Singapore HDB flat(300k) which he bought under his name for my brother and i
(We were having problems with our stepfather and needed a place nearer to school, hence he bought the house and moved us out)
It was not in writing, but everyone on both sides of the family knows his intention was to pass the assets down to his children.
A point to make is - he willed all his CPF money to us when he made a long overseas trip 8 years ago, which is now in our hands.
He left his other major assets to his wife, and she does not dispute that that flat and remaining assets(200k) were for his children.
We will be thrown out of our HDB flat when MUIS chooses to excercise their "right" to sell the flat for profit.
His assets will be sold soon and all the profits will go to MUIS.
Because i am not a Muslim, i will not be allowed to inheriet what was supposed to be ours - this fact is not disputed by either side of the family.
This is clearly not right, and im sure they are others like me (non muslims with muslim fathers) suffering in silence.
But is there anything we can do in this sitatuion?
I will pay well for the necessary legal services to go to court or otherwise.
I just want an honest opinion and need to know if i have a case or if there are better options to take.
I wish to keep my home (ive been staying in the HDB flat with my brother the last 6 years) and we live each day in fear of our inevitable eviction.
