I was talking to a local bar owner recently. A few months back, there was an issue involving a minor and a fight on his property, for which the local police got a warrant for his security recording system. (It is a computer based system, so they actually take his laptop.) Only one officer has any knowledge of how to view the video, so he doesn't get his system back until that officer has had time to view it.

While the local police had his surveillance system, one of his customers was assulted. Obviously, not having his system, he doesn't have the taped evidence the assulted individual needs, nor that he needs to ban the involved persons from his bar.

He called the company that provided his recording system and they have never heard of any other systems being seized in a warrant. (They have systems in all 50 states.) How is it that the local police are getting away with this?... he tells me that they have actually taken his system more than once, sometimes not returning it for over a month.

First of all he doesn't need a recording to 86 some one you can refuse service to anyone for any reason (well besides protected classes, he cant refuse people service because of race, sex, religion all of those run things) but he can kick anyone out for anything might not like the way the guy looked at him who knows. second there should be enough witnesses to testify agents the assaulter himself and the assaulted and whom ever elts was there. i don't see a problem. perhaps he should by a cheep desktop computer and 2 hard drives so when the cops need it they can take one hard drive and he can put in the spare. may be a worthwile investment.
