seller disclosure contradiction

i recently bought a home 1 month ago, the sellers disclosure states there are no cracks on the property. i found cracks in the garage leading inside the house and cracks on the outside back wall.
what can i do? who would be my first line of contact?

I am just starting to buying in RE market again after 2 yrs'

I was flipping then and also buying rentals 2-3-4-5 yrs ago
and now waiting for downturn which is here.

Ok according the California Office of Real Estate any visual
thing that is wrong with the house that can easily and
clearly be seened by a walk-thru inspection MUST BE
disclosed and IF NOT most likely will constitute fraud
by the non-disclosing party usually seller and his agent

Go the the CA RE GOV pages and you can actually find
the codes, written info statiing the above.

If this is true with your state and you catch someone doing
this to you all one really needs to do is talk to the sellers
broker and he should ASAP cover your costs to repair BUT
pick your contractor not his BUDDY friend.

If he does not I would first File a complaint with 3 people
at your state

1. Office of RE

2. Attorney General of your State

3. City Attorney

Now the file will propably go to one person most likely your
city attorney depending on the state you are in.

I did this with the Sate of AZ on another similar matter and they
went after the person like you would not believe becuase
Fraud can be a criminal matter and in my case they went
after the person criminally where he had to make restitution
to me for all and any damages as well as a $2,500 fine
so some states have some real teeth. Look into your state
because some have incredibly stiff finds!!!

And it is all FREE believe me was I ever surprised!!!!
