My son has a truck that he bought and financed in October of 2006. When he recieved his title in the mail there was no lien recorded on the title. I have checked with the state of Oklahoma and there was never a lien recorded. His title shows that it is a clear title.

Now he is wanting to sell the vehicle and pocket the money.

My question is, Can he go to jail for this? He has a clear title. I am concerned that he will get into a lot of trouble for this.

Thanks for any help you can give.

But.....the lien holder the bank, still has a lien on it. So is your son making payments?

He knows there is a lien on the truck, he should not sell it because the bank will still repo the truck due to lack of payments, and turn him in late to the credit bureau. It will not be too hard to prove he sold this truck fraudulantly if he has made bank payments. The person buying this vehicle is subject to getting ir repoed as well once they register it and the bank goes looking for the truck.

This is why lien holders generally hold titles now until the vehicles are paid off.

This is a bad bad idea, and your son will face legal trouble from the bank, and from the buyer. I do not see how he will not be caught.
