Separated but not legally

I am separated from my husband for 4 months now. It appears we will be divorcing. But until then I have a question. I left him in another city 4 months ago for abuse and started over in a city an hour from him. We have 2 children and have remained cordial for the kids' sake and they are happy with that. I have since gotten a 3 bedroom home for us and the company I work for is letting me work from home. He just told me that he is moving here as well so he can be closer to the kids. But I know that is not all of it. He has it in his head that we are going to work it out. We are not. Can he move here and then say that since we are married that he is entitled to move into my duplex that I am renting even though he is not on the lease????? I am in Texas and there is no legal separation here. He is a true blooded con artist and can get away with ANYTHING. I am afraid that I uprooted my children and my life for him to just push his way back in by using legal jargen? Can he do that or am I safe with just telling him that he is not welcome in MY home?
 
If you file for divorce, you can also petition for temporary custody and rights to the marital residence. Police reports documenting the abuse would be helpful to your case.

I doubt that you can be forced to allow him into your rental since he never lived there.
 
Thanks. He is just so slick and does not want this separation so I feel like he will go to any length to make it hard for me. Thanks again.
 
Thank you! I do have the police reports and he is still going to court for the abuse so I can take that info and move forward! Thanks!
