Separation---FLorida or NC

I am from North Carolina but have relocated to Florida as of January 2008. My husband resides in NC. I want to file for separation in order to receive full custody of our two kids(they are in Massachusetts with my sister---they have temp. custody). Is it better and/or quicker to file in Florida or NC?

Normally the court that has jurisdiction is the last county/state the couple resided in for at least 6 months. However why does someone other than either parent have custody of children and was this court ordered?
