My husband recently left aand moved to Missuori. What I would like to know is, I live in New Jersey and want to know if he can file for divorce or separation in Missouri. Please note that we were married in New Jersey 36 years ago, and our home is owned in New Jersey.

I would like to know if he will be able to file in Missouri for divorce since we were married in New Jersey 36 years ago and our home is owned by both of us and is in New Jersey. Does the State of Missouri have jurisdiction over property separation since the house is in New Jersey? Does he have to come back to file in New Jersey and if he files first, do I have to go to Missouri to answer the complaint? If I file first, does he have to come here?

Your husband can file for divorce in Missouri after he has lived there for 90 days. If he files first, then the divorce proceedings will take place in Missouri, although you may hire an attorney to represent you in court.

If you file first, then the proceedings will take place in New Jersey.

I suggest that you file ASAP.

The Missouri courts will have jurisdiction over the division of all marital property if your husband files there.
