shared fence replaced 3yrs ago- neighbor now claiming need to move portion of it
The wooden fence enclosing our property was old and in need of repair- the fence is a shared fence. After the next door neighbors' dog broke through the fence a second time - we decided to go ahead and replace the fence. We asked all the neighbors if they could pitch in, but- no one could do it at the time. The old fence was torn down, and the new one put up in the same place. It looks great and we have been happy with it- no complaints from any of the nieghbors. That was 3yrs ago. We are now selling our home.
The neighbor with the dog- let's call her 'Sybill' - hasn't lived in the home for over a year. She has left it vacant - with overgrown weeds and newspapers piling up the driveway. We see her from time to time and have always been cordial. The other day, our realtor called us. 'Sybill' contacted her and claims that we agreed to move a portion of the fence because it was on her property. We never had any such conversation. She has never indicated that any portion of the fence was on her property. She watched the fence being put up and never said a word. Our realtor told her that she needed to contact us. It has been 4 days and Sybill has still not attempted to contact us. Measuring the length of our fence, there is a small portion where we could possibly be 2-4 inches over the length indicated on the plat map.
What do I need to disclose to potential buyers of our home?
If it is 2-4 inches into her property can she make us move it- when she shares the
fence as well?
Any advice is appreciated!
