Shell game with my position

I was terminated by my employer, along with several others in the same position. We were told that they had to reduce their headcount due to a revenue decrease and therefore they were eliminating the position. In order to get a severance compensation they had us sign a document agreeing not to pursue them with litigation. My attorney told me to sign it because I had no recourse under the circumstances.

Now I have found out that we have been replaced ... same job ... same responsibilities ... they have just given the position a different job title. Is this legal?

If I can't sue can I file a complaint with the EEOC?
 
Yes, it is legal. The law does not give you the right of rehire unless a legally binding and enforceable contract says you do.

Do you have a valid and supportable reason to believe that you were laid off BECAUSE OF your race, religion, national origin, genetic information, gender, disability, pregnancy, or because you are over 40? If not, the EEOC will not be interested.
 
I am over 50 but unfortunately, I can't prove that this was the reason for my termination. What they did was not illegal ... but it sure was unethical. Thanks for your prompt response.
