My nephew got caught shop lifting at grorcery store $33 dollars worth of stuff. He was 17 when it happen but his court date is after his 18th b-day shouldnt he be charge as a minor.

He *shouldn't* be shoplifting in the first place.

Whether to charge him as a juvenile or an adult is the decision of the DA. If we're talking only a few days, the DA may have thought that your nephew was not entitled to take advantage of a technicality.

You aren't an adult until 18, but most states charge 17 year olds as adults.
