I am 18, was shoplifting at a drug store, with my 6 year old niece beside me. It was around $60 worth, I might of given my soc security wrong.. not sure, and when I was asked to sign the I was looking through the ticket then what I believe was the report for the store, and the guy just snatched it away from me saying I just didn't want to sign so he wrote 'refused', is that bad? I said I wasn't done reading I want to look at what I'm being accused of. Also, I tried apologizing and offering him favors, stating that my mom has an auto shop, I work for car insurance, and my dad works in construction... he said why didn't I try to apologize before, it was too late. I'm scared he might of wrote it as 'bribing attemp'? and the police told me they weren't arresting me due to the fact I ha my niece with me in order to avoid trouble to my cousin, they would of otherwise, I thanked me and asked if this was going to be on my record, they said most likely, but I should try to get a lawyer, maybe the store would let it go off the record, I'm wondering if that'd be a settlement? or, is there anything I can do to prevent this to be on my record. I am a deferred action applicant, I have employment due to it, and my last concern is, will they take my benefits away, or deport me?

You have a problem, you appear to be a serial shoplifter.
Then you compound things by offering a bribe.
You got off lucky, but things are going to collide.
You work for someone, and then offer to give away their stuff, not yours. Stupid.
Okay, appear in court as directed, plead not guilty, admit to nothing, be polite, and use your right to remain silent; lastly ask for a court appointed lawyer or hire your own.
Then tell EVERYTHING to your lawyer.
You could very well lose your current deferred status, or you WILL NOT get it again!
You've made BIG, VERY BIG trouble for yourself.

STOP STEALING, STOP BEING SNEAKY, STOP TAKING LITTLE KIDS AROUND CRIMES, OBEY THE LAW.

You keep doing this PRISON or JAIL is in your future.

If you are an immigrant or an illegal alien yes deportation is possible. having this on your record is also possible. You need to discuss plea options with an Attorney right away. In addition please explain the deferred action your talking about. If you have a previous case then ACD or Diversion wont likely be an option for you

The deferred action is regarding immigration enforcement by the Feds. Obama administration policy after the Dream Act failed.

With all due respect, the time to worry about having a criminal record is BEFORE you commit a crime. It is now no longer within your control whether you do or do not.

Actually there may yet still be an option to avoid a record

The best option is don't steal. If you want it, buy it. If you can't afford it, leave it alone.

one little shoplifting and you think you are going to be deported? Not with this administration.

My ex came in on student visa yet never went to school and worked illegally for three years (student visa fraud). Got green card by not mentioning her first arrest for theft (material misrepresentation). Failed to mention it again when conditions were removed. Has acquired four additional theft convictions (crimes of moral turpitude). Denied citizenship 2 years ago but continues to reside in US and break our laws. Unfortunately I found this all out after the fact. It's ICE that needs reform not the immigration laws.
