When I was a minor about 8 years ago, I was caught shoplifting at a major retailer, first time offense and only. Since I was a minor, my criminal background is clean.

Fast forward present day I have received a job offer for a corporate position from the same retailer that I was caught from. I'm aware of the National theft database and found out my name is still on their list after meeting with their LP recently.

HOWEVER - I also found out they have the incorrect date of birth, no SSN, but the correct name and address. Is there any possibility to pass their background check because of a simple error with the date of birth? I'm assuming they use name, SSN, date of birth, address to do an auto-search and if my date of birth is incorrect, obviously it would fly under the radar?

Your LEGAL question is can you beat the system, again?
Will they hire a thief?
I wouldn't.
Let's hope they don't either, but you might get lucky, again.

I know there is more than one database that theft can be reported to. However, The National Retail Database doesn't include incidents in which the person was under 18 when the theft occurred. OP said they are on it but was a minor. I wonder if the wrong DOB might have something to do with it being on there.

Agree that after 7 yrs. name is supposed to fall off the database but from what I have read several places, it doesn't always happen since it is owned by a private co. & not governmental one & there is no regulation upon it.

You are better off to own up to your past mistakes. If they catch you being dishonest about it then you won't be hired for sure. Your juvenile incident alone won't likely prevent you from getting the job, but your current behavior will.

Agree, employers do not like applicants/employees who lie. You are better off when telling the truth. An employer would more likely forgive a shoplifting charge 8 yrs. ago as a minor than a current lie.

Applicants should always answer all questions on an employment application truthfully - read how the question is worded, then answer truthfully.
