Shoplifting, Larceny, Robbery, Theft Shoplifted with police involved

I live in MA and im a 20 yrs old female. To make a long story short, i went into Store name, brought clothes in the dressing room, stole a pair of shorts, put the tags in the other clothes, put the clothes back, and went into another store to use their bathroom to change.

Walking in the mall, i got stopped by a guy who was holding up the tags (they prob only cost like 20 dollars). I didn't want to make a scene by running away, and i didnt know if there were any police in the mall either so i just said ok and went with him with no arguments.

I signed a couple papers, one being banned from Store name for a year and another to pay them $350, they told me it was a lawsuit from Store name. They called the police, the cop arrived, was actually pretty nice and told me he wasn't going to arrest me because my shorts were clearly damp (i told him what happened with spilling water on them, but i also mentioned that i wasnt trying to justify it) and i have no record. He said i'll be getting a summons to court in the mail.

I don't know how long i have to pay Store name the $350, and are they taking me to court with a lawsuit? Should i call Store name and speak to the LP and ask when i have to pay the money or will i get a letter in the mail?

Also, my dad has a lawyer, should i bring him with me to court and is there any way this wont go on my record? The only thing is i can hardly afford the $350 nevermind a lawyer and i don't want my parents to find out (im staying with them at the moment).

The LP guy said they'll prob give me 6 months probation... but my girl friend got caught shoplifting, she had to pay the store and go to court but they dismissed it because she "acted sincere" and didn't have a record. I don't know what to do!
 
Sorry that was so long but i wanted to explain everything.

I've been thinking... when the LP guy stopped me in the mall, could i have said "Do you have me on video stealing?" obviously he would've said no because i did it in the dressing room. Could i have just kept walking & left? I know there's no point in thinking about that NOW but what proof did he really have? Tags in a pair of shorts that i put back... how did they know i took those particular shorts, unless they watched my every move on camera & saw how many items i took & how many i put back after. Is that enough proof to stop me in the mall?
 
For your protection your post has been edited to remove store name. This and other forums are viewable by anyone and seachable via search Engines. naming store can ID you. You do not want your admission here showing up in court!

They will want money right away. Do not call Store or its LP department. Call the numbe ron the letter when you get it

Your facing criminal charges and a criminal record yes you need a Lawyer

Great set of friends they steal too! :rolleyes: The LP or your friends are not Lawyers or Judges. You want to talk to a Lawyer and not assume these others know what they are talking abouyt. They are usually wrong!
 
Not to sound rude, but your question about the video is irrelevant. They don't need video, or any other proof other than you removed the merchandise from the store without payment.

Think about days before cameras. Eyewitness testimony is how they went to court.

Advice:

#1 Retain counsel, you are facing criminal charges - and let them do the talking for you.
#2 Pay your civil demand in a timely manner. If you cannot afford it, set up a payment plan.
#3 Do not steal anymore.

You went into a fitting room with shorts.
You came out without shorts.
You left the tags in there, but no shorts.

2+2=4.

Oh, and the "keep walking" tactic usually gets you handcuffed.

No. I had more than just the one pair of shorts with me in the fitting room. I didn't leave the tags in there, i put them in another pair of shorts that i had put back.
 
Ok you entered with shorts
You left and short were not seen
Fitting room was inspected no shorts were found
You were stopped on suspcion of theft
Shorts were found on your person

That is pretty cut and dry

Once again, they counted the # of shorts you took in you came out minus 1, they're not in the fitting room, not on the rack, unless you ate them where do you think the shorts are?
