When I was 14, I was caught shoplifting @ Store name with a friend; misdemeanor larceny. Police were called, info taken down, and I went to a diversion program for 4 weeks, and on probation. If no further incident occurred, then when I turn 17 my record would be expunged.

I had not shoplifted since, but then I began to develop it into a habit AGAIN. It made me feel horrible at times, but I got kind of a rush from it, and I was positive I wouldn't be caught. I just turned 16 a few weeks ago. I was caught yesterday trying to walk out with $96 worth of clothing in my bag; I cooperated and, because the store was just too busy, police were NOT called. (So lucky, I know.) My name, address, phone number, and school ID were taken down and put into some sort of online database--is that the shoplifters' database that needs to be subscribed to? No photos or fingerprints done.

What does this mean? This was my second shoplifting offense, but there is no police record of it, and so..will my record still be expunged @ 17 if no later incident occurs? How long does my name stay in the database; forever? If forever, I assume that means I can't get a job in retail, at least for a store that subscribe to this database. But I am sure I was put into a similar database at Bloomingdale's two years ago; with two entries, does this mean I will be charged for a second offense? As I left, an employee said to me, "Don't be coming back." Does that mean I am banned?

I really do know I will not shoplift again; it is simply not worth it and it makes me hate myself. I was really close this time--or was I? I will begin apply to colleges next year; will this affect that? Will my probation officer know?

They just told me a restitution fee would come in the mail.

If probation finds out your program was violated. Its unlikely they will since there was no Police involvment. You appear to have a theft problem though. Unless you care to flip Burgers your whole and never attend College you shoud seek help for your theft issues. The database you speak of gets purge (from what I am told) every 10 years or so. There may be more than one database so it spossible you are now on two databases. Since we do not know what, if any, databases you might be in its tough to guess

To be honest, yeah, I think I might have a problem. I think that now, this is out of my system, but..I want to make absolute sure. Once I began, and knew how easy it was, the temptation is there, the knowledge of how to is there--and I worry come two years from now, I will be in the same situation. Not desirable, especially with the future I have planned for myself. Can you recommend to me some sort of support group, educational class, etc. that is free and credible? Thank you.

Free no but the NASP has a program you can do at home. Its not terribly expensive and if court sees you have enrolled Judge will surely smile upon your efforts. Contact this Admin via Pm he can give you contact info to that groups Director. Keep in mind free isnt always free and you get what you pay for! You can also PM me for that info if you like

I am curious to know, though: If somehow my probation officer does learn of a second offense, what happens with a 2nd offense when still on probation for the first, as a minor? Criminal record?

That would be up to courts and your Probation officer. I suspect yes a criminal record and possible jail for violation

Oh my god, that is terrifying. Jail @ 16, and a criminal record to boot for bad impulse control in the first two decades of my life. That would make housing, a job, college, graduate school..all of it so difficult. Oh no, I suppose I should just pray and count on the unlikelihood, due to lack of police involvement. Though, I'm sure you don't know this as you aren't a probational officer, but do you know if PO's generally check shoplifter databases? I imagine she wouldn't.. Can I still have charges pressed against me after the fact? Though no police were called, they have all my contact info, and definitely could grab ahold of me if they wanted to. Is that common for them to do so?

I don't know why Admin did not see it but I did. This site discourages the naming of store. This is for your protection. I have edited the store name from your post
