I was with a friend at the mall , she told me she needed a new alphet for the holidays. I said OK lets go. As we Go in the store she tells me shes going to steal a couple things because she doesn't have enough money. I got scared because I've never done before, she told me she knew how to just act normal so I did, As were leaving the store well actually we did leave the store a random guys go in front of us and tells us that we need to go with him because we been caught stealing, I told him I don't have anything on me but he said he didn't care I was Still with her through the whole process. We got sent to an office we gave them the stuff but then he called the cops. The cops were nice enough to let us go but he still said we will be going to court and we were also gonna get charged for a fine there that was maybe up to $500. My questions are Am I going to jail? Whats really going to happen? Will it stay on my record? I'm 18yrs old and go to a community college. Should I plead guilty? I havent got the letter yet because it happened yesterday. Any Help?????
 
Jail is an option but not likely depending on any prior record. Yes this will stay on your record again depending on what you and your Attorney decide to do. You should not plead guilty you should consult an Attorney and discuss options like ACD or diversion. You should also remove name of store from your post. I personally know of or have been involved in situations where message board posts (like yours) have been used in court, used to file charges, used to fire people and more. You do not want to make any posts that might ID you. Naming the store might do that and is not important in getting the answers you need
 
What is ACD or Diversion? And I honestly cant afford an attorney. But Whats going to happen once I get that first letter from the court. This just happened yesterday.
 
There will be two letters one a civil demand and one about court. Not being able to afford an Attorney should not stop you from consulting one. ACD or Diversion varies by county but in short they work like a guilty verdict with fines, community service probation etc but after you complete program your case is dismissed so "no record". I didnt get the information, but ok so as soon as I get the letter what do I do ? call the court and find out if they have an attorney I can speak to? Because I dont mind paying a fine little by little and then have no record that sounds great to me.
