i am 23 yrs old. lives in CA. caught shoplifting in Store name yesterday 2/28/20 for the amount of about 35 dollars. no police were called. Store name just let me signed two papers. one stating that i stay away from Store name.. and the other one admitting of the shoplifting incident. i have a clean record. and this is my first offense. they just gave me a piece paper that would have me pay civil demand that would be sent mail. i called the LP department today and said my case is not yet on board, that i would have to call back on thursday. i couldnt wait any longer. based on the information i gave you.. what should i expect? i am very scared.

i am in nursing school and will be graduating this dec. i am scared this will hinder my application for my RN liscence. and also i am only on a working permit status here in USA. i am so scared.. whats the best bet that could happen and whats the worst? thank you.
 
Expect what? You got off easy. Once you pay Civil Demand this is over. No Police were called and it appears no criminal charges will filed long as you pay civil demand
 
BUt I'm not sure if LP called the cops or report the incident to police. LP just told me that the information is only on their company. How likely will they press criminal charges? Will this incident show on my record?
 
I'm so scared. I was only in the LP Office less than 30mins. Sign papers, they took my picture too and ssn. But that was it. They let me go. Gave the civil demand notice and told me if I have any question to call that number. I can't sleep eat or concentrate in class. Please answer anything you know about this ty
 
hi i want to post the civil demand notice they gave me and please tell me what does that mean because it says something about having the civil demand charge.. seperate from the criminal charges that i may be facing. thank you..

CIVIL DEMAND NOTICE

You have been detained for a shoplifting incident and/or for causing a loss to store name.

State laws five merchants a civil claim for damages and/or a monetary penalty against you (or the parent of guardian of a juvenile), as a result of this incident.

This civil claim is separate from any criminal punishment or criminal penalties, and is also separate from and promissory agreement related to this incident.

This civil claim may take into consideration:
*The retail vaue of the merchandise
*The costs associated with providing Loss Prevention prote4ction to our building and its contents
*And other damages and/or penalties as permitted by law

You will soon receive a letter from Federated Department Store's Civil Recovery Department explaining the amount owed and seeking promp payment.
 
ok.. but in most cases that you know and heard of.. like being the item is less than 30 dollars.. adult.. im ca.. and first offense.. no police called.. what ussually happens?
 
You get a letter of Civl Demand and thats it. This not a promise or guarantee such will be your case but this is the norm for what you desribed
 
Okay one more question.. what if I've always shop their and this is not the first time I've shoplifted from their store. Would they review my case and name and find more evidence on there camera to charge me for more ?
 
I'm saying what if ive shoplifted their before but this is my first time being caught.. would they find more videos and tape to see if they could charge me for more? Would they look at the days ive shopped their and go back to that day and look at the video if ive shoplifted?

Possibly which could result in felony charges
 
Okay.. but what do you know about the process if you got caught for the first time.. what usually they do? LP caught you.. send it to manager for review? I mean if its your first time and your record is clear. How do they dcide? Whats usually the process?
 
This depends on store policy. In most cases if charges were not filed at time of arrest they wont be unless something new comes up or you reoffend or, violate ban
 
Okay I called the civil demand number of the store and my case us still not up. They say if usually takes 1week. And then the guy on the phone asked me if police were called and I said no. So he said more likely I just have to pay the 325 civil demand and that's it.. I mean I'm still scared.. but what do you think? how unlikely or likely that they will still press criminal charges on me?
 
My opinion (its only my opinion) is that long as you pay Civil Demand, obey any ban and, do not steal again no charges will be filed. The store gains nothing by filing criminal charges
