Hello,
I've recently been caught shoplifting, and have been doing nothing but research in efforts to learn more about my upcoming court date. I am in michigan, was caught at a store with less than 100 dollars of merch. (i'm stupid, very dumb and will never do something as pitiful again) I have talked to a criminal defense attorney and he told me there was a first offender program that i might be able to partake in. i'm not sure if there is a diversion program in my area or if i'm eligible. I can't afford an attorney, so i plan on asking for a PD at the trial unless they offer me a lesser sentence on the spot. I've heard a mixed bag from different people- some say they were immediately offered a lesser charge (deferred sentence, diversion program) others say they weren't offered one without the help of a lawyer or pd. I'll be able to ask more questions and contact the courts when I get my court paperwork which hasn't arrived yet. (I was caught, police were called but didn't arrive. he said i would receive a civil demand and a court summons in 10 days, but he seemed unsure about that. i'm hearing now it can take upwards of 6 months maybe- and they might not press charges at all if I pay the civil demand. but i'm not holding my breath)
The manager of the store and the LP officer seemed to shrug off my court date, saying that since this is my first offense if wouldn't go on my record. The criminal defense attorney i talked to also said that it depended on whether or not the city or county was prosecuting me. he said if it was the city, even if they didn't offer me a lesser charge i wouldn't have a criminal background. however he said if it was the county, if i plead guilty and didn't get into a program and would be fingerprinted and charged and get a background.
I have a few questions, though. On another forum they said it would be wise to send the store a letter of apology. I did so, a short letter to the manager i talked to and the LP officer (both were very nice and i was very cooperative). i didn't sign anything saying I wouldn't go back to the store- the manager just said "please don't come back here until this is over with, or any (of these stores) until this is over with." Now I am hearing from this forum that sending the letter was bad idea. Can I get in trouble for that?
I am already signed up to do some community service in a couple of weeks. I heard that might be a good idea. I also just read on here that I should take an online shoplifting course and should ask you about it. I want to do whatever I can to rectify this horrible mistake. I'm applying for grad school soon, a full time employee, and i'm trying to do the right thing and get my life in order. Any suggestions would be appreciated. Thank you so much for your help.

You have many questions throughout your posts if you couyld list them it might be easier. I will try though

One of the courses recommended is offered by NASP. The letter to store was bad idea as this letter can show up in court and be used against you

Paying Civil Demand should not increase or decrease your chances of charges being filed. However not paying can increase those odds in favor of prosecution. Do not deal with DA without an Attorney Public or Private!

If you have further questions please ask and myself for another member of this board should reply

well, I had already admitted to what I did when I was there- I do not plan on try to plead not guilty. All I did was apoligize and thank them for being kind to me. How would they use that against me if they already have video footage and a confession?

Your admitance in store carrries less weight than a written confession given later. Its done its done but depending on wording this can be more damaging than what you admitted to in store and DA can use while bargainning a plea deal.

Yes it's done, but hopefully the store won't get upset about it (I don't think they would) and it would work to my benefit. I'm finding a lot of people telling me a lot can simply depend on what the judge ate for breakfast. After all that I read, i'm learning that this can go many MANY different ways. I'm hoping that my particular case goes down in a good way. I've heard from several different people on these (and others) forums that they were offered a first offenders programs right off the bat, without a PD or an attorney- they just showed up, and were offered these things. Have you heard of that often, or are these just a very lucky few that happen to post and the rest of the jaded people out there are too pissed to tell the public of their unfortunate results?
I know it would be speculation, but i'm curious. Thank you for all you help. And if you can message me with a link to the anti-shoplifting site i would appreciate it.
Thanks again

Didnt you gamble and lose when you stole? Why gamble with this more? Yes you might be offered a deferred sentence right off the bat you might not. There might be a better offer an Attorney can get for you also! Its your call but I suggest you start calling Lawyers and see who offers free consultation so you can be armed with knowledge. One shoplifting course that I recommend is offered by NASP you can visit there site.

I am already signed up to do some community service in a couple of weeks.

How does doing community service help you? Is this arranged with the court as some sort of sentence. Or are you just doing it looks good that you are a volunteer? Please help me understand.

The poster is attempting to get CS out of the way early by starting before being told to or is doing so to show Judge remorse. Both are postive things. The pitfall is if the CS the poster choosing is not one recognized and accepted by courts or cannot be proven or documented
