Shoplifting, Larceny, Robbery, Theft Shoplifting First Offense

Hi I posted my situation here before that happened a little over a month ago. Basically since then I got an Attorney. She said that since this was a first time offense and I had a good record I would get the Diversion program so "don't worry". I gave her my school transcripts, deans list letter, acceptance letter, and a letter of recommendation to her because she said she needed to turn that stuff into the State Attorney in order to get the Diversion. She said I wouldn't have to go to court and after I completed the diversion program I could get this thing expunged off my record.

Just yesterday I received my plea hearing court date in the mail saying if I don't come then I will be arrested. My parents called the state attorneys office and they said they were never going to offer the Diversion program as an option, and that they see this all the time so it isn't "fair" to give it to me. My Attorney already promised it to me though, and now I don't know who to believe because I will more than likely have to do Probation and Work Camp. They said that is my option if I Plea Guilty. But if I plea not guilty it will be more court costs and not a good decision.

Is there nothing I can do to get the Diversion program anymore? I am honestly a good kid and this Probation / Work Camp will not do anything for me. Lesson has been learned already and I already have enough trouble sleeping as is.

I have just reread your original topic. The reason DA is not going with Diversion is because your case is likely a felony! Go back and read what you were told in original topic. Why your Attorney told you what he did I do not understand but he knows your local laws better than I.
